I. GENERAL PROVISIONS
These General Terms and Conditions govern the services provided by Eurograde Consult Ltd. (“Agency”) to employers – legal entities and individuals (“Client”) in relation to recruitment, consulting and assistance for access of third-country nationals to the Bulgarian labour market.
The General Terms and Conditions have an informative and regulatory character and apply to the use of the services via the Agency’s website or via direct engagement, insofar as nothing different is agreed in an individual mediation contract.
II. LEGAL STATUS AND REGISTRATION OF THE AGENCY
Eurograde Consult Ltd. is registered in the Register of Private Employment Agencies with the Employment Agency under Certificate No. 4015 / 06.11.2025, on the basis of Order No. RD-03-6 / 30.05.2025.
The Agency carries out its activities in accordance with:
• The Labour Migration and Labour Mobility Act (LMLMA);
• The Foreigners in the Republic of Bulgaria Act (FRBA);
• The Labour Code;
• All secondary legislation and internal rules of the Employment Agency and the Ministry of Interior.
III. TYPES OF PROCEDURES AND SERVICES PROVIDED BY THE AGENCY
The Agency provides assistance for the following categories of employment for third-country nationals:
1. Seasonal employment up to 90 days (registration regime)
• Registration with the Employment Agency under Annex No. 5;
• Procedure without work permit;
• A valid visa for seasonal employment is required (where applicable);
• Allowed “only in two sectors” defined by the Ministry of Labour and Social Policy:
o hospitality and restaurant services;
o agriculture, forestry and fisheries.
• Not subject to quota regime;
• Possibility for “extension up to 180 days where the conditions of Art. 24l FRBA are fulfilled;
• (however, the extension is not a change of the registration – it requires a separate procedure before the Ministry of Interior).
2. Seasonal employment from 90 days to 9 months (permit regime, “Seasonal Worker Permit”)
• Residence and work permit issued by the Ministry of Interior (Art. 24k FRBA);
• The application is submitted by the employer when the candidate is outside Bulgaria;
• Requires a positive opinion by the Employment Agency;
• The permit is valid from 90 days to 9 months within a 12-month period;
• Allowed only in seasonal sectors, without quota restrictions;
• Allows a one-off extension within the 9-month period, without leaving the country.
3. Long-term employment 1–3 years (“Single Residence and Work Permit”)
• Applicable for sectors outside the seasonal ones;
• Subject to quota regime under the LMLMA:
o up to 35% foreign nationals in SMEs;
o up to 20% foreign nationals in companies with over 250 employees.
• Requires proof of qualification, experience, education documents;
• Issued by the Ministry of Interior after an opinion by the Employment Agency;
• Validity up to 1 year (first issuance) and up to 3 years (renewal).
4. Highly qualified employment (“EU Blue Card”)
• Requires higher education and qualification;
• Minimum remuneration – 1.5 times the average salary for the country;
• Outside the quota regime;
• Issued for a period of up to 5 years;
• Accompanying family members receive the right to work.
5. Intra-corporate transfer
• For managers, specialists and trainees seconded from international groups;
• Permit issued by the Ministry of Interior after an opinion by the Employment Agency;
• Duration – up to 3 years for managers/specialists and up to 1 year for trainees;
• Not subject to quota limitations.
6. Other regimes for which the Agency may provide assistance
• Posting of workers for services (3 or 6 months);
• Work as a person of Bulgarian origin;
• Students – full-time education;
• Researchers;
• Trainees under an employment contract;
IV. APPLICATION OF THE QUOTA REGIME
The quota regime applies only to:
• long-term employment (Single Permit);
• posting of workers, where the employment relationship is considered employment under the LMLMA;
It does NOT apply to:
• seasonal employment up to 90 days;
• seasonal employment up to 9 months;
• EU Blue Card;
• intra-corporate transfer;
• Bulgarian origin;
• students;
• researchers;
• trainees.
V. LIMITATION OF LIABILITY
The Agency is not liable for:
• refusals by the Ministry of Interior, Employment Agency, Ministry of Foreign Affairs or other state authorities;
• delays caused by institutions or by the employer;
• actions of candidates, including provision of false data;
• changes in legislation affecting the procedures.
The Agency does NOT guarantee the issuance of permits or visas – the decision always lies with the competent state authorities.
VI. CONTRACTUAL RELATIONS
The specific rights and obligations between the Agency and the Client are governed
by an individual mediation contract.
The General Terms and Conditions serve for information purposes and do not override the contractual clauses.
VII. USE OF THE WEBSITE
All texts and materials are the intellectual property of Eurograde Consult Ltd.
Copying or distribution is prohibited without the explicit written consent of the Company.
VIII. AMENDMENT OF THE GENERAL TERMS AND CONDITIONS
The Agency may update these General Terms and Conditions in case of changes
in legislation or internal rules.
